The terms that govern your use of visitedby.ai: the service, accounts, billing through Paddle, your data, and the limits of our measurements.

These terms are an agreement between you and VisitedBy.AI Ltd, a company registered in the United Kingdom (“we”, “us”). By creating an account or using visitedby.ai (the “Service”), you agree to them. If you use the Service on behalf of a company, you confirm you have authority to bind that company.

01THE SERVICE

visitedby.ai measures how AI answer engines (such as ChatGPT, Perplexity, Gemini and Google AI Overviews) talk about brands, and classifies the AI-originated visits and AI crawler reads that reach your website. Measurements are statistical estimates built from repeated sampling of AI systems we do not control. We report them with confidence intervals where sample sizes allow, but we cannot guarantee that any AI system will behave consistently, nor that our measurements predict its behavior for any individual user.

02ACCOUNTS & ORGANIZATIONS

You are responsible for your account credentials and for everything done through your account. An organization’s owner controls its plan, billing, team members and Spaces; teammates get the access the owner or an admin grants them. Keep your contact email accurate; it is how we reach you about billing and service changes.

03PLANS, BILLING & TAXES

Paid plans are recurring subscriptions billed through our merchant of record, Paddle. Paddle handles payment processing, invoices, and sales tax/VAT; your contract for payment processing is with Paddle, and their checkout terms apply to purchases. Each organization holds one subscription; plan changes prorate immediately. Plan limits (brand Spaces, tracked prompts, engines, seats, research searches) are described on the pricing page and enforced in the product. We may change prices or plan structures with at least 30 days’ notice; changes never apply retroactively to a period you have already paid for.

04CANCELLATION & REFUNDS

You can cancel any time from the billing portal; the subscription stays active until the end of the paid period and does not renew. Refunds are governed by our Refund Policy.

05YOUR DATA

You own your data. That includes your brand configuration, your prompts and topics, and the analytics collected from your own websites through our tracking snippet. We process visitor data from your sites as your processor, under the terms of our Privacy Policy. You are responsible for ensuring you may lawfully deploy our tracking on your sites, including any notice or consent your jurisdiction requires. On account deletion we remove your data within 30 days, except minimal records we must keep for legal or accounting reasons.

06ACCEPTABLE USE

You agree not to:

  • resell, scrape, or programmatically extract the Service beyond its intended use;
  • use the Service to track brands or sites you have no legitimate interest in;
  • attempt to disrupt, overload, or probe the Service’s infrastructure;
  • misrepresent our measurements, or present modified data as ours.

We may suspend accounts that violate these rules, after notice where practical.

07INTELLECTUAL PROPERTY

The Service, its software, design and methodology remain ours. We grant you a non-exclusive, non-transferable right to use the Service while you have an active account. Feedback you send us may be used to improve the product without obligation.

08DISCLAIMERS & LIABILITY

The Service is provided “as is”. To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages, loss of profits, or loss of data. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot be limited by law.

09CHANGES & TERMINATION

We may update these terms; material changes will be announced by email or in the product at least 14 days before they take effect. Continued use after that constitutes acceptance. You may stop using the Service at any time; we may terminate accounts that breach these terms.

10GOVERNING LAW & CONTACT

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without regard to conflict-of-law rules. Questions go to hi@visitedby.ai.
